Appeals Court Reinstates Bowe Bergdahl’s Conviction, Ruling Judge Lacked Jurisdiction
Appeals Court Restores Desertion Conviction
An appeals court has ruled that a judge lacked the legal power and jurisdiction to vacate the military conviction of former U.S. Army soldier Bowe Bergdahl, reinstating his desertion conviction.
The ruling reverses a 2023 court decision that had previously wiped out Bergdahl’s conviction. According to the appellate court’s finding, the judge who set aside the military verdict acted beyond the scope of judicial authority in nullifying the original proceedings.
Overturning of the 2023 Ruling
Bergdahl’s military conviction stemmed from court-martial proceedings related to his desertion in Afghanistan. A lower court judge had previously voided the conviction in 2023, setting aside the findings of the military court.
However, the appeals panel determined that the lower court lacked the jurisdiction required to overturn the court-martial outcome. With the appellate court determining that the previous ruling was invalid, Bergdahl’s conviction remains in effect.
